Duende Retreats – Private Getaway Terms & Conditions

These Terms & Conditions apply to all travel arrangements booked with Tingle Limited, trading as Duende Retreats (“Duende”, “we”, “us”, “our”), including but not limited to hosted retreats, private getaways, bespoke itineraries, and custom travel packages.

By confirming a booking with Duende, you (“you”, “client”, “traveller”) agree to be bound by these Terms & Conditions on behalf of yourself and all travellers included in the booking.

1. Contract & Booking Confirmation

1.1 A binding contract comes into effect once Duende has issued a written booking confirmation or invoice and the required deposit has been received.

1.2 The person making the booking confirms they are authorised to accept these Terms & Conditions on behalf of all travellers listed.

1.3 All correspondence and agreements will be conducted with the lead booking contact unless otherwise agreed.

2. Nature of Our Services

2.1 Duende specialises in curated travel experiences, including Private Getaways and bespoke itineraries, which may include accommodation, experiences, guides, transfers, meals, and other services as outlined in your confirmed proposal.

2.2 All itineraries are offered and priced as complete packages. Individual components are not sold separately.

2.3 Pricing reflects negotiated partner rates, advance contracting, and itinerary design. As such, itemised cost breakdowns are not provided.

2.4 Any additions, upgrades, or changes requested after booking confirmation are subject to availability and may incur additional costs.

2.5 All itineraries, proposals, and quotations provided by Duende are indicative only and subject to availability at the time of booking. Duende does not hold rooms, experiences, or services on provisional hold unless explicitly confirmed in writing.

2.6 Prices quoted in proposals may change due to supplier availability, seasonal demand, currency fluctuations, or supplier price adjustments. Duende is not obligated to honour the original quoted price until the booking has been confirmed and secured with suppliers.

2.7 Even after a client has confirmed their intention to proceed and paid a deposit, supplier pricing may change prior to Duende securing the services. This can occur with boutique accommodations, experiences, guides, and transport providers.

2.8 Where a supplier increases their rate prior to final confirmation, Duende will notify the client and obtain approval before proceeding with the booking at the revised price. If the revised price is not accepted, Duende will endeavour to offer suitable alternatives where possible.

3. Pricing & Payments

3.1 All prices are quoted in British Pounds Sterling (GBP) unless otherwise stated.

3.2 A non-refundable deposit of 50% of the total booking value is required at the time of booking to secure and confirm your reservation.

3.3 The remaining balance must be paid in full no later than 100 days prior to the scheduled departure date, unless otherwise specified in writing.

3.4 If a booking is made within 100 days of departure, full payment is required at the time of booking.

3.5 Failure to make payment by the stated due date may result in cancellation of the booking, and any payments made may be retained in accordance with cancellation terms and supplier policies.

3.6 Bank fees, currency conversion charges, or international transfer costs are the responsibility of the client.

3.7 Duende reserves the right to release any booking where payment deadlines are not met.

4. Cancellations by the Client

4.1 All cancellations must be made in writing and will take effect from the date received by Duende.

4.2 Cancellation charges will apply in accordance with supplier terms and the timing of cancellation. Deposits are non-refundable unless explicitly stated otherwise.

4.3 Many services used in Private Getaways (including boutique accommodations, private guides, and experiences) have strict cancellation policies and may be non-refundable once confirmed.

4.4 No refunds will be given for unused services, late arrivals, early departures, or voluntary changes made during travel.

5. Changes to Bookings

5.1 Any changes requested after confirmation are subject to availability and may result in revised pricing and administration fees.

5.2 Duende reserves the right to make reasonable changes to the itinerary where necessary due to operational, safety, or logistical reasons.

5.3 Where significant changes are required, suitable alternatives will be offered wherever possible.

6. Cancellations or Changes by Duende

6.1 In the rare event that Duende must cancel or materially alter your booking due to circumstances beyond our control, we will endeavour to offer an alternative arrangement or refund as appropriate.

6.2 Duende is not responsible for costs incurred by clients for independently booked services such as flights, insurance, or visas.

7. Travel Insurance

7.1 Comprehensive travel insurance is mandatory for all travellers and must be purchased prior to travel.

7.2 Insurance should include, at a minimum, coverage for medical expenses, emergency evacuation, trip cancellation or interruption, personal belongings, and activities included in your itinerary.

7.3 Proof of insurance details may be requested prior to departure.

8. Health, Safety & Fitness to Travel

8.1 It is your responsibility to ensure you are medically fit to travel and participate in the activities included in your itinerary.

8.2 You are responsible for complying with all health, vaccination, and entry requirements for your destination.

8.3 Duende reserves the right to refuse participation in any activity where health or safety may be compromised.

9. Passports, Visas & Documentation

9.1 You are responsible for ensuring all travellers hold valid passports, visas, and any other required documentation.

9.2 Duende is not liable for any costs, losses, or disruptions resulting from incorrect or missing documentation.

10. Liability & Responsibility

10.1 Duende acts as an organiser and agent for third-party suppliers such as hotels, transport providers, and experience operators.

10.2 While we take reasonable care in selecting our partners, Duende is not liable for the acts, omissions, or failures of third-party suppliers.

10.3 Duende is not responsible for delays, cancellations, injuries, losses, or additional expenses arising from events outside our control, including but not limited to weather, strikes, natural disasters, political unrest, or government actions.

10.4 Any issues must be reported as soon as possible during travel to allow us the opportunity to assist.

11. Behaviour & Conduct

11.1 Travellers are expected to behave responsibly and respectfully toward hosts, guides, fellow travellers, and local communities.

11.2 Duende reserves the right to terminate participation without refund if behaviour is deemed disruptive, unsafe, or unlawful.

12. Third-Party Activities & Optional Services

12.1 Any optional or independently booked activities are subject to the terms and conditions of the third-party provider.

12.2 Duende is not responsible for services booked outside the confirmed itinerary.

13. Governing Law

13.1 These Terms & Conditions are governed by and construed in accordance with the laws of England and Wales.

13.2 Any disputes shall be subject to the exclusive jurisdiction of the English courts.

14. Force Majeure

14.1 Duende shall not be liable for any failure, delay, alteration, or cancellation of travel arrangements caused by events beyond our reasonable control.

14.2 Such events may include, but are not limited to natural disasters, extreme weather conditions, wildfires, pandemics or public health emergencies, government restrictions or border closures, war, civil unrest, political instability, strikes or labour disputes, transport disruptions, supplier insolvency or operational failure, acts of terrorism, or any other unforeseeable circumstances beyond our control.

14.3 In the event that a Force Majeure event affects your itinerary, Duende will make reasonable efforts to provide suitable alternatives or assist in rearranging travel services where possible. However, refunds are subject to the policies of third-party suppliers and cannot be guaranteed.

14.4 Duende shall not be responsible for additional costs incurred by the traveller including flights, additional accommodation, transportation, insurance claims, or other travel expenses.

15. Supplier Insolvency & Third-Party Responsibility

15.1 Duende works with a network of carefully selected third-party suppliers including hotels, transport providers, guides, and experience operators.

15.2 While Duende takes reasonable care in selecting reputable partners, we cannot be held responsible for the financial failure, insolvency, operational decisions, or service disruptions of any third-party supplier.

15.3 In the event that a supplier becomes unavailable, Duende will make reasonable efforts to provide an alternative of comparable standard where possible.

15.4 Any refunds, credits, or compensation related to supplier failures are subject solely to the supplier’s own policies and financial ability to provide them.

16. Payment Disputes & Chargebacks

16.1 By confirming a booking and making payment, the client agrees to these Terms & Conditions.

16.2 Clients agree not to initiate chargebacks, payment disputes, or payment reversals with their bank or payment provider without first contacting Duende to resolve the matter.

16.3 In the event of an unjustified chargeback or payment dispute, the client agrees that Duende reserves the right to recover all outstanding amounts owed and that the client will be responsible for any associated legal, banking, or administrative costs incurred.

16.4 Any payment disputes must be raised with Duende in writing within 14 days of the issue arising.

17. Itinerary Flexibility

17.1 Duende designs bespoke itineraries that may involve boutique properties, private guides, and locally operated experiences.

17.2 Due to the nature of travel and the destinations we operate in, itineraries may require adjustments before or during travel.

17.3 Duende reserves the right to make reasonable changes to accommodation, guides or experience providers, transport arrangements, activity timing, or order of events where necessary due to availability, operational requirements, weather conditions, safety considerations, or supplier changes.

17.4 Where possible, alternative services of a similar standard will be provided.

17.5 Such changes shall not constitute a material breach of contract.
